Conductor Sues CSX Transportation over W. Va. Goose Attack

A railroad conductor who says he was attacked by a goose in West Virginia while performing a brake inspection is suing CSX Transportation.

Aaron E. Richards claims a goose nesting in the Keyser Receiving Yard near Ravenswood, W. Va., suddenly jumped out from under a railcar at 1:15 a.m. on April 23, 2005, and struck him, causing him to fall.

Richards' lawsuit, filed Feb. 4 in U.S. District Court in Huntington, says he is likely to continue to suffer from his injuries and the loss of future earnings.

His lawsuit seeks more than $75,000 and blames CSX for knowing about the goose and not doing anything about it.

Calls to CSX and Richard's attorney, W. Michael Frazier, were not immediately returned on Friday.
